It Is Not Necessary to Link Property of Illegal Origin with Any Crime: Galyan
The Constitutional Court has deemed the law and all of its provisions constitutional, indicating that we are dealing with a fully constitutional law and its regulations. At the same time, the Constitutional Court has interpreted the law from the perspective of its objectives, highlighting two legitimate aims: one is the fight against crimes, and the other is the fight against corruption.
This was stated by Justice Minister Surbhi Galyan in the National Assembly. “In this context, the court has identified two subject groups: one consists of officials, while the other includes individuals who are not public officials. In the case of the former, the objectives of combating corruption and preventing corruption are applicable and operational, and from this perspective, it is absolutely not necessary to link property of illegal origin owned by officials with any crime. However, when dealing with individuals who are not public officials, it is necessary to establish a specific link between the crime and the property acquired, while maintaining the principle of balance of probabilities. During this time, I was able to find the relevant provision which I want to refer to, and I would ask the professional community to pay attention to the relevant point of the Constitutional Court's decision, as I believe that after reading it, all kinds of disputes will be resolved.
