The Corruption Prevention Commission Initiates Proceedings Against Hayk Marutyan
The Corruption Prevention Commission held three meetings and made seven decisions from November 26 to December 20, 2019. According to reports from the Commission, two proceedings have been initiated, one of which is on the Commission's initiative.
Proceedings have been initiated against Yerevan Mayor Hayk Marutyan for reportedly violating the requirements of incompatibility. The decision notes that on December 5, 2019, various online media outlets, referencing the 'Zhoghovurd' newspaper, published articles entitled 'Hayk Marutyan has violated the law for about a year', 'Hayk Marutyan and 'Two and a Half': the mayor's violations are exposed', and others, specifically mentioning that Hayk Marutyan, alongside his official duties, is also the director of 'Two and a Half' LLC and that he has managed his private company since taking office on October 13, 2018.
According to Article 31, Section 1 of the Law on Public Service of the Republic of Armenia, individuals holding public office and public servants cannot hold positions in public or local self-governance bodies unrelated to their status, occupy positions in commercial organizations, or engage in entrepreneurial activities, except for scientific, educational, and creative work.
Article 27, Section 1, paragraph 2 of the Law on the Corruption Prevention Commission (June 9, 2017, H.O.-96-N) stipulates that the Commission may initiate proceedings based on media publications regarding violations of incompatibility requirements, other restrictions, codes of conduct, and situations of conflict of interest.
Considering the reports published by the media and the legislative provisions, the Commission believes that there are signs of apparent violation of incompatibility requirements in the actions of Yerevan Mayor Hayk Marutyan. Taking these facts into account and guided by Article 27, Section 1, paragraph 2, part 5, as well as Article 31, Section 2 of the law, the Commission decided to initiate proceedings against Hayk Marutyan for apparent violation of incompatibility requirements. The decision to initiate proceedings will be sent to Yerevan Mayor Hayk Marutyan within three days.
