California is proposing to impose fines on influencers for undisclosed political advertising related to political candidates. According to the Associated Press, the bill's authors are suggesting that the state's election commission be given the authority to impose a fine of up to $5,000 for each violation without the need to go to court.

The tightening of regulations has been prompted by the rapid spread of political advertising through social media. American election campaigns are increasingly collaborating not only with high-profile figures but also with smaller bloggers who provide access to more niche and loyal audiences.

In 2023, California required content creators to disclose if they received payment for posts from a political campaign. However, implementing the existing mechanism has proven complex; the election commission can seek court orders to compel influencers to disclose payment facts, with investigations potentially taking several months. The new bill, proposed by Democrat Mark Berman, aims to simplify this process. If an influencer fails to indicate that they were compensated for political content, both the author and the political committee could face fines.

“Voters should have the right to know whether campaigns are paying for the messages they see,” Berman stated.
