Some Judge is Sitting There, Stamping What They Want Like a Stamp: Levon Kocharyan
The appeal against the Constitutional Court's decision in the case of the second President of Armenia, Robert Kocharyan, which his defense team submitted to the Court of Appeals on September 17, is with a judge whose son is participating in protests against Robert Kocharyan's supporters.
This was stated today, October 7, during a conversation with reporters by Levon Kocharyan, the son of the second President of Armenia, Robert Kocharyan.
Commenting on the motion submitted for the recusal of judge Anna Danibekyan in Robert Kocharyan's case, Levon Kocharyan said: “There is no legal process in all this. There is nothing legal; they assign themselves guilty roles and come to talk. We have a very good legal team, they are very knowledgeable, the difference from the other side is noticeable. What good does it do, whatever they say, there is some judge sitting there who is stamping what they want like a stamp. Of course, there are grounds for recusal. This person is ignoring the Constitutional Court's decision. The appeal against that decision, which we submitted to the Court of Appeals on September 17, has fallen to the hands of a person whose child was outside that day protesting against us—Mher Arghamanyan. This means his son was happily celebrating the decision we are appealing against in the Court of Appeals. That person does not say, 'Folks, I cannot examine this case, I cannot be objective.' A bystander would begin to have doubts; they live in the same house. We give him a recusal request, and he tells us, 'You know, I am leaving the case without examination anyway,' with some absurd justification, but that person had no right to accept the case for review.”
It should be noted that Robert Kocharyan's lawyer, Haik Alumyanyan, has just submitted a recusal motion to presiding judge Anna Danibekyan. The lawyer believes there are several circumstances that exclude Anna Danibekyan's participation as a judge in this particular case. According to Alumyanyan, there are two grounds for recusal: Anna Danibekyan cannot be considered an appropriate court for reviewing this case, and she has a biased negative attitude towards Robert Kocharyan.
