Kocharian's Defense Team Submits Request for Disciplinary Action Against Judge Mher Argyamanyan
The defense team of the second President of Armenia, Robert Kocharian, has submitted a request to the Ministry of Justice of Armenia to hold Judge Mher Argyamanyan of the Court of Appeal accountable for disciplinary actions. This was stated by Aram Vardevanyan in a conversation with "Pastinfo."
According to him, the request was submitted at the end of last week. "I have great hope that the Ministry of Justice will respond appropriately. I have noticed a tendency that the Ministry is indeed trying to be more proactive in such reports," Vardevanyan said, noting that the presented factual circumstances are sufficient for initiating a disciplinary proceeding and making the issue subject to discussion in the Council of Court of Judges.
"In other words, lawyers cannot bring the matter directly to the Council of Court of Judges; rather, it must be done through mediation. One of the possible links is the Disciplinary Commission, and the second is the Ministry of Justice. I sincerely hope that the Ministry will address such obvious violations and behaviors, especially when there are clear grounds for recusal, and no action is taken by the judge," Vardevanyan emphasized.
He pointed out that judges often voluntarily announce their recusal. "In this case, we can say that by the time Judge Argyamanyan made his decision, which he had already accepted, quite interesting materials had already circulated in the media regarding his problematic impartiality. At the very least, he could have addressed this even without announcing a recusal, but here there was no response at all," Vardevanyan stressed, emphasizing that Judge Argyamanyan should have declared his recusal in such a case.
