Possibility of Avoiding Criminal Liability in Case of Hitting a Person
The Ministry of Justice proposes an amendment to the Criminal Code to include new provisions in Article 342. This article pertains to violations of traffic rules that result in harm to an individual's health.
The ministry suggests adding a clause that allows individuals committing offenses under the first part of Article 342 for the first time to be exempt from criminal liability if there is a mutually agreed settlement based on free and voluntary expression between the offender and the victim.
It is also stipulated that if an individual has previously been exempted from criminal liability on this basis, they cannot be exempted again under the same grounds. This means that under the proposed regulation, if a person violates traffic rules and causes harm to another individual, they may be exempt from criminal liability in the first such incident if the parties reach a settlement and agree accordingly.
