Onik Gasparyan Dismissed from Office; Legal Processes Cannot Change This, Vahagn Hovakimyan
The Chief of the General Staff, Onik Gasparyan, has been dismissed from his position, and this fact is irrevocable; it cannot be changed by any legal process. This was stated by Vahagn Hovakimyan, a member of the Armenian Parliament's 'My Step' faction, on his Facebook page.
He cited the second part of Article 139 of the Constitution regarding the draft decrees presented to the President of the Republic: 'The respective act can be returned by the proposing or requesting body within three days. If the competent authority does not accept that objection, the President of the Republic signs the corresponding act or refers it to the Constitutional Court.' Furthermore, the third part of Article 139 states: 'If the President of the Republic fails to comply with the requirements set forth in the second part of this article, the corresponding act shall enter into force by the force of law.'
Since the draft decree regarding the dismissal of Chief of the General Staff Onik Gasparyan was not sent to the Constitutional Court by the President of the Republic, the corresponding decree has entered into force by law based on Article 139, paragraph 3, and that is final.
