Kocharyan's Defenders Submit Motion for Judge's Recusal
The defense attorney for Armenia's second President Robert Kocharyan, Hayk Alumyann, announced during today's court session that he intends to submit a motion for the recusal of Judge Anna Danibekyan.
“However, I have learned that my colleague intends to file a motion regarding the measure of restraint for Armen Gevorgyan. I do not object if the court gives priority to that motion, especially considering that in your decision to schedule the trial, you stated that the issue of restraint would be discussed as a priority,” he said.
Alumyann inquired whether the court would find that he would lose the right to submit his motion after his colleague’s motion was presented. If so, he preferred to submit it now; otherwise, he believes the measure of restraint is more critical as it pertains to the question of restraint.
“Given that you have already prepared a recusal motion, the court does not see the possibility to discuss another motion before resolving this one,” the judge stated.
Alumyann mentioned that there are several circumstances that preclude his participation in this criminal case. The defense attorney presented two grounds for the judge's recusal: first, that she cannot be considered a proper court, and second, that she has a biased negative attitude towards Robert Kocharyan.
