Investigative Group Established in NSS for Separated Part of October 27 Case

An investigative group has been formed in the National Security Service (NSS) regarding the separated part of the October 27 case. This was stated by Gor Abrahamyan, advisor to the Prosecutor General of Armenia, in response to a question from HJ.

The Prosecutor's Office has partially satisfied the request of Anahet Bakhshyan, the legal successor of the victim in the October 27 case, who had called for the formation of an investigative group for the separated matter.

According to Bakhshyan, to ensure the objectivity, completeness, and comprehensiveness of the investigation, it is planned to involve investigators from the Investigative Committee of Armenia in the NSS investigative group.

As for Bakhshyan's other request, which asked for the criminal case to be transferred to a different investigative authority, passing it from the NSS to the Special Investigation Service (SIS), that request was denied.

The rejection was justified on the grounds that transferring the conduct of the proceedings to the NSS investigation department fully complies with the rules of investigative authority. According to the procedural norms for raising an objection, an objection may be raised not to the investigative body but to the investigator conducting the proceedings. However, no arguments were presented in the complaint regarding the existence of grounds for objection,” Abrahamyan stated.

It is noteworthy that Anahet Bakhshyan had applied to the Prosecutor's Office on December 18, demanding the annulment of the decision to close the separated part of the October 27 case and to start a new investigation. Bakhshyan's complaint was satisfied, the decision of the preliminary investigation body from November 11, 2004, to discontinue the criminal case was annulled, and the preliminary investigation was entrusted to the NSS.
