Former Minister of Emergency Situations Applies to Constitutional Court; Case Dismissed

Former Minister of Emergency Situations Andranik Piloyan has submitted an application to the Constitutional Court challenging the compliance of part 3 of Article 383 of the Criminal Procedure Code of the Republic of Armenia with the Constitution. This was reported by Faktinfo.

In his application, Piloyan requested the Constitutional Court to declare part 3 of Article 383 of the Criminal Procedure Code void as it contradicts Article 61 of the Constitution. Specifically, he argued that this provision allows the Court of Cassation to reject an appeal without any explanation regarding the absence of a legal development issue concerning the contested court act.

Presenting the procedural background of his criminal case, the Applicant noted that when a cassation appeal is presented based on the argument that there is a legal development issue related to the contested court act, the Court of Cassation is not obligated to justify the absence of such an issue. In particular, the contested article implies that it enables the Court of Cassation to reject the appeal without any explanation regarding the lack of a legal development issue.

The Constitutional Court rejected the examination of the case, stating that the issue raised in the application is not subject to the Court's review.
