Esteemed Prosecutor, What Are You Smoking? Ruben Melikyan's Controversial Post
Lawyer Ruben Melikyan writes: "Imagine you are a judge. You hold the power of the third authority, which is to restrain and balance the other two branches of power, especially the executive branch.
How would you act if you were presented with an accusation that, for example, a father committed 'abuse of power' for prohibiting his own child from playing with a phone? Absurd, right? I assure you, we have seen much more absurd accusations than this.
So, what would you do if you were a judge and received such an accusation? If I were a judge, during the initial part of the court session, while discussing the issue of terminating the criminal prosecution, I would address the parties, more precisely, the prosecutor: - Esteemed prosecutor, what are you smoking, that you accuse a person without public authority of a crime that implies public authority, and to make matters worse, you bring the case to court?
After hearing the response 'We are not smoking anything,' I would immediately terminate the criminal prosecution, citing the doctrine that 'the court is not an exhibition of baseless accusations' and expressing the position that failing to terminate a dead-on-arrival accusation would undermine the very essence of justice.
So, respond - what would you do? (a) You would do the same (b) You would investigate, examine, and ultimately acquit the defendant (c) You would send the case to the nearest tattoo parlor to ink a guilty verdict (d) You would recuse yourself based on the premise that the defendant's academic advisor awarded you an honorary title of 'best steward of the coffee pot' in the past.
