Lawyer Haik Alumyann Comments on Court's Decision to Refer Criminal Case to the Constitutional Court
The court may refrain from taking any action until the Constitutional Court makes its decision. Commenting on the decision to refer the March 1 case to the Constitutional Court, Robert Kocharian's lawyer Haik Alumyann told Sputnik Armenia.
According to him, this process could take around two months.
"This means that the proceedings are suspended until the Constitutional Court rules on the constitutionality of Article 300.1 of the Criminal Code. The question of the constitutionality of Article 300.1 is now before the Constitutional Court," said Alumyann, recalling that Kocharian is accused under this article of undermining the constitutional order.
Since the article came into force after the events of March 1, 2008, the Constitutional Court must respond to whether it is constitutional for the article to apply to actions that occurred before this article was included in the criminal code.
Earlier, it became known that the proceedings regarding former President of Armenia Robert Kocharian, former Deputy Prime Minister Armen Gevorgyan, former Minister of Defense Seyran Ohanyan, and former Chief of General Staff Yuri Khachaturov have been suspended by the decision of the Yerevan court of general jurisdiction and referred to the Constitutional Court.
