Court Acknowledges Violation of Arsen Babayan's Rights, Varosyan
The Court of Appeals (presided over by Judge Arsen Nikoghosyan) has issued a ruling today regarding the complaint we filed against the decision of the Yerevan City Court to select detention as a preventive measure for Arsen Babayan.
This was reported by his lawyer, Yervand Varosyan, on his Facebook page. He specifically noted, "As became clear upon the publication of the ruling, the court acknowledged the fact of the violation of Arsen Babayan's rights, reasoning that almost all arguments presented by the defense were valid, starting from the absence of reasonable suspicion, the violation of deadlines for discussing the legality of the arrest, the circumstances excluding criminal prosecution, to the lack of legal grounds for detention.
At the same time, considering the fact that other non-custodial preventive measures have already been applied to Arsen Babayan and he is free, the court formally decided to reject the presented complaint. After receiving and reviewing the text of the decision, we will determine whether it satisfies us in its entirety or not."
