Fact: Either You Judge, or You Are Judged – The Judge in Arsen Babayan's Case is in a Difficult Position
The newspaper "Fact" reports that the Yerevan Court of General Jurisdiction, presided over by Karen Farghoyan, decided yesterday to recognize the arrest of former Deputy Chief of Staff of the National Assembly, Arsen Babayan, as unlawful.
However, as strange as it may seem, the same court simultaneously decided to grant the petition of the Investigative Committee’s investigator and impose a two-month detention on Babayan. The matter was reviewed the day before, and the decision was published yesterday.
According to the newspaper's information, Judge Farghoyan was in quite a difficult position since, fundamentally, the grounds for detention were absent. Sources from the newspaper report that he has approached the Supreme Judicial Council to know what actions to take. The Supreme Judicial Council has clearly stated the dictum that "either you judge, or you are judged," emphasizing that there is "no alternative" and that a decision on custody must be made.
As a result, the arrest has been deemed unlawful, but Babayan has been detained.
