Kocharian's Lawyers Appeal Rejection
The legal team of Armenia's second president, Robert Kocharian, filed an appeal against the first instance court's decision to incarcerate R. Kocharian on September 19.
On September 4, the Constitutional Court published its ruling, invalidating Article 35 of the Criminal Procedure Code of the Republic of Armenia, noting that it contradicts several provisions of the Constitution, specifically, Article 27, paragraph 4; Article 61, paragraph 1; Article 63, paragraph 1; and Article 75.
Basing their appeal on this ruling, R. Kocharian's lawyers requested the immediate lifting of the presidential pre-trial detention and the cessation of criminal prosecution against him. However, the Yerevan first instance court, presided over by Anna Danibekyan, rejected the defense's request.
