Mandatory Labeling Requirement for AI-Generated Content Enforced in the EU

The European Union has officially implemented a requirement for mandatory labeling of content generated by artificial intelligence. This regulation specifically applies to photographs, recordings, and videos created or altered by AI that depict real individuals, places, objects, or events.

Moreover, text generated by AI on topics of public interest that has been published without human editing is also subject to labeling. The specified requirement does not extend to auxiliary AI systems, such as photo editing programs or spell checkers. Exceptions also include materials that are 'clearly artistic, creative, satirical, or fictitious in nature.'

Both AI providers and users who apply such content in commercial or professional activities are obligated to label accordingly. This group includes authorities, media outlets, companies, public associations, and influential individuals (influencers). In case of violations of these rules, companies may face fines of up to €15 million or up to 3% of their annual global turnover. For institutions, agencies, and bodies of the European Union, the maximum penalty has been set at €750,000. For small and medium enterprises, the penalties will be calculated based on the principle of proportionality.
