Disseminated Misinformation is Distorted: The State Revenue Committee
Disseminated misinformation on social networks claiming that individuals with mandatory obligations cannot leave the country is distorted. This was reported by the State Revenue Committee.
"We inform you that Article 48 of the new law on 'Enforcement Proceedings' of the Republic of Armenia, which will come into force on July 1, 2025, stipulates the limitation of the exit rights of individuals wanted by enforcement authorities based on the decision of an enforcement officer. Specifically:
- The enforcement officer limits the exit rights of an individual wanted by the enforcement authorities based on a judicial act that imposes an exit ban.
- The general jurisdiction (civil) court of first instance located where the respective service division is found makes a decision to limit the exit rights of the wanted debtor, if it is impossible to execute the act subject to enforcement without the personal participation of the wanted person, and all legally permissible measures taken by the enforcement officer to locate him have been in vain.
- The court examines the enforcement officer's application and makes a decision based on the materials submitted with the application, without convening a court session, within ten days of receiving the application. The court’s decision can be appealed, but the execution of the decision cannot be suspended by the appellate court's judicial act.
- The limitation of the exit rights of the wanted debtor is immediately lifted by the enforcement officer after the termination of the wanted status or the annulment of the court decision limiting the exit rights, but no later than 24 hours.
- The enforcement officer immediately registers all necessary information regarding the limitation and removal of the exit rights of the wanted debtor in the border electronic management information system in accordance with the procedure established by the Government, but no later than 24 hours.
We also inform you that after the law comes into force, the exit ban for persons wanted by enforcement authorities will be regulated solely within the context of the stated regulations," the statement read.
