In Case of Garbage Dumping, Community Leaders Will Be Held Accountable: "Fact"

The newspaper "Fact" reports: "The police propose to make amendments and additions to the RA Code on Administrative Offenses. The Ministry of Environment is also involved in the drafting process.

This law is expected to reduce the practice of dumping waste in unplanned places and areas by applying more effective and preventive accountability mechanisms. It will enable quicker identification of administrative violations and raise public awareness about keeping the environment clean.

Monitoring of waste sites is planned, which will help reduce their harmful impact. The adoption of the initiative is not expected to require additional financial resources; on the contrary, as anticipated by the proposing authority, there will be a significant increase in revenues in the state budget.

Specifically emphasizing the increase of public accountability for dumping consumable waste in undesignated places, and the prompt detection of violations, the proposal reserves the application of accountability measures for administrative offenses specified in parts 3-4, 10-11 of Article 43.1 of the Code on Administrative Offenses to the RA police as well.

Subsequently, the bill establishes accountability measures for waste site operators who fail to conduct monitoring in accordance with government regulations. It is also proposed to supplement the code with Article 43.2, reserving the application of accountability measures for administrative offenses specified in parts 1 and 2 of that article to the inspection body responsible for state control (supervision) over the implementation of environmental legislation.

At the same time, it is suggested to develop appropriate mechanisms for applying accountability measures to community leaders in the event of the emergence of garbage dumps and to provide alternative measures for detecting violations established by the relevant article of the code."
