Report Submitted to Prosecutor's Office, Directed to Special Investigation Service, Which Rejected the Case – Defender
“There are no new motions; we are waiting for the hearing, and the date of the hearing is still unknown,” said Arthur Hovhannisyan, one of the lawyers of former Chief of General Staff Onik Gasparyan, in an interview with Hraparak.
Speaking about the upcoming hearing, the lawyer stated: “The upcoming hearing will discuss our motion to change the subject matter of our claim, recognizing not only the absence of legal relations for Mr. Gasparyan's dismissal but also the lack of legal relations for appointing Artak Davtyan.”
The lawyer also mentioned that the authorities are not executing the court's decision, which ordered the provisional measures for the claim: “They are obstructing Mr. Gasparyan. A report was submitted to the Prosecutor's Office, which directed it to the Special Investigation Service, and the SIS rejected the case. Now we will appeal the decision in court.”
Onik Gasparyan had applied to the Administrative Court of Armenia on March 10, requesting the annulment of the order regarding his dismissal from the position of Chief of the General Staff of the Armed Forces, which was affirmed by the Prime Minister's announcement on March 10, 2021, declaring that Onik Gasparyan was legally dismissed from the position.
