Prosecutor Explains Why Gukasian Should Remain in Custody
During the court hearing of the mayor of Gyumri, Vardan Gukasian, on December 17, the prosecution announced that during the preliminary investigation, detention had been used as a measure against him, and his right to communication had been restricted, except for contact with close relatives and family members.
The prosecutor stated that the courts have already recorded that there is sufficient factual evidence in the criminal proceedings indicating that the defendant is connected to the commission of the criminal act attributed to him. The decision of the first-instance court has been appealed, but the appellate court has also concurred with this position.
The prosecution noted that at this stage, the existence of reasonable suspicion does not require additional detailed justification, as the data available in the criminal case are sufficient to confirm it. According to the prosecutor, there is a high risk that Vardan Gukasian, if released, may commit a new criminal act or fail to fulfill the procedural obligations imposed on the defendant, including exerting unlawful influence on individuals involved in the case.
It was also mentioned that another criminal case is currently being examined in the same court, which, according to the prosecution, may testify to the commission of several criminal acts by the defendant and characterize his future behavior. There are also recordings in the case where Vardan Gukasian speaks about possible illegal actions in the future.
The public prosecutor emphasized that considering the former high position of the defendant, his reputation, and the fact that most witnesses worked directly under his supervision, there is a real possibility of exerting influence on them. On this basis, a motion was submitted to extend Vardan Gukasian's detention for another three months, noting that the evidence examination phase is still ahead and may take a long time.
During the court session, Vardan Gukasian responded from his seat, stating: “It’s not enough. I can't behave otherwise, because they have brought me to this place as innocent, just stepping on their faces.”
